What are the conditions for becoming a home-based sales assistant?

To become a door-to-door salesperson, you need to meet certain conditions:

• You must be of legal age.
• You must not have been convicted of a criminal offence.
• You must not be on a Contrat Emploi Solidarité (CES).
• Not to be receiving early retirement benefits.
• Not be subject to a management ban or personal bankruptcy.

If you are not registered with the RCS-RSAC, declare your activity to the CFE of the URSSAF where you live. If you are an employee, the employer must complete a declaration prior to hiring you within eight days of hiring you.

Incompatibilities with certain professions

If you want to start selling from home, you should be aware that certain professions are not compatible with this activity. These include

• civil servant
• notary
• bailiff
• lawyers
• chartered accountant and statutory auditor,
• architect
• surveyor,
• administrator and judicial representative,
• auctioneers,
• dietician
• etc.

These incompatibilities may be linked to the existence of an exclusivity clause in the employment contract or to the code of ethics for certain professions. Despite these exceptions, it is perfectly possible to combine a salaried job with an additional job in the home. Make sure that there is no unfair competition between your home-based sales activity and the business for which you are employed. Finally, if you are a civil servant, you will need to make a specific application to obtain the right to carry out a complementary activity.
